1Our Role as a Marketplace

Motor Vault Kenya operates as a digital dropshipping marketplace and intermediary. We facilitate the sale of vehicles and spare parts between buyers and independent third-party showrooms, hubs, and suppliers.

• We do not take physical possession of the inventory listed on our platform unless explicitly stated.
• All product descriptions, specifications, and assurances are based on information provided by the respective vendor hubs.

2Payments and M-Pesa Transactions

• Currency: All prices are listed in Kenyan Shillings (KES).
• Payment Gateway: We process payments primarily via Safaricom’s Lipa Na M-Pesa. By initiating a transaction (e.g., via STK Push), you authorize Motor Vault Kenya to deduct the specified amount.
• Order Confirmation: An order is only considered accepted and forwarded to the supplier once the M-Pesa transaction is successfully completed and verified by our system.

3Shipping and Delivery (Dropshipping)

• Direct Dispatch: Upon payment confirmation, your order is forwarded to the respective supplier or showroom, who is responsible for directly dispatching the vehicle or part to your specified address.
• Timelines: Delivery times vary depending on the supplier's location and your destination within Kenya. Estimated delivery times provided at checkout are guidelines, not guarantees.
• Risk of Loss: The risk of loss or damage to a product passes to the buyer upon delivery by the supplier or their chosen courier.

4Returns, Refunds, and Disputes

Due to the nature of dropshipping, our return policy requires strict coordination between the buyer, Motor Vault Kenya, and the supplier.

• Reporting an Issue: If a part is defective, damaged, or incorrect, you must contact Motor Vault Kenya support within 48 hours of delivery.
• Vehicle Purchases: For full vehicle purchases, all sales are subject to the specific inspection and return policies of the fulfilling showroom. Buyers are strongly encouraged to arrange physical inspections prior to finalizing large transfers.
• Refund Processing: Approved refunds will be processed back to the original M-Pesa number used for the transaction within 5-7 business days. We reserve the right to deny refunds for parts that have been installed, modified, or damaged by the buyer.

5Vendor Hubs and "Winner Winner" Premium Listings

For independent showrooms and hubs registering to sell on Motor Vault Kenya:

• Accuracy of Listings: Vendors are solely responsible for ensuring the accuracy of vehicle specs, part conditions, pricing, and availability.
• The "Winner Winner" System (Priority Ranking): Vendors may opt to pay for premium visibility. The highest ranking is awarded to the first vendor to complete the priority payment.
• Non-Refundable: Payments made for priority ranking slots are final and non-refundable, even if the vehicle sells immediately or is removed by the vendor before the promotional period expires.
• Account Termination: We reserve the right to suspend or terminate any vendor hub that repeatedly supplies substandard parts, engages in fraudulent listings, or fails to fulfill orders promptly.

6Intellectual Property

The luxury design, custom graphics, UI layout (including the Bento grid and specific OLED dark mode branding), logo, and text on this website are the intellectual property of Motor Vault Kenya. They may not be copied, reproduced, or used without our express written permission.

7Limitation of Liability

To the maximum extent permitted by Kenyan law, Motor Vault Kenya shall not be liable for any indirect, incidental, or consequential damages arising from the use of our platform, the failure of a supplier to deliver, or any defects in the vehicles or parts purchased through our site.

8Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
